It is the IEP TEAMS responsibility to REVIEW ALL of the evaluation INFORMATION, to identify ANY related SERVICES the child needs, and to INCLUDE them in the IEP.

IDEA PROCTECTS children and SUPPORTS advocates by using a TEAM model to devise educational plans.

  • WHO is on YOUR IEP TEAM?

  • WHO is able to TALK about the instructional IMPLICATIONS of your child’s evaluation, assessments, observations, and class work?

  • WHO helps your TEAM plan APPROPRIATE instruction to address YOUR child’s needs?

  • WHO helps your team MOVE scores TO APPROPRIATE instruction?

IS IT a member of the team already, such as the child’s teacher?

IS IT the public agency representative?

IS IT someone else entirely, such as the school psychologist?

IS IT someone you TRUST to CONSOLIDATE your information and concerns into an APPROPRIATE plan?

THIS IEP TEAM MEMBER IS IMPERITIVE

IDEA States families have this protection here:

Sec. 300.321 Statute/Regs Main » Regulations » Part B » Subpart D » Section 300.321

IEP Team(4) A representative of the public agency who—

(i) Is qualified to provide, or supervise the provision of, specially designed instruction to meet the unique needs of children with disabilities;

(ii) Is knowledgeable about the general education curriculum; and

(iii) Is knowledgeable about the availability of resources of the public agency.

(5) An individual who can interpret the instructional implications of evaluation results, who may be a member of the team described in paragraphs (a)(2) through (a)(6) of this section;

Advocates who PREPARE, interpret results and consolidate information PRIOR to meetings.

Did you know that school districts are required by federal and state law to provide copies of assessment reports and other educational records BEFORE the IEP meeting?

  • Are you interpreting results prior to meetings?

  • Are you considering discussing if a related service is appropriate?

Related Services: IF a particular related service is going to be DISCUSSED in an IEP meeting, it would be APPROPRIATE (not required) for such personnel to be included or INVOLVED in DEVELOPING the IEP.

Are you planning to DISCUSS a POSSIBLE RELATED SERVICE in the next IEP team meeting?

IDEA states that, at the discretion of the PARENT or the public agency, “other individuals who have knowledge or special expertise regarding the child, INCLUDING related services personnel as appropriate” MAY be part of a child’s IEP team.
